Solicitors Professional Indemnity Insurance

Professional indemnity insurance is mandatory for solicitors practising in England and Wales. Under Section 37 of the Solicitors Act 1974, the Law Society was authorised to establish rules governing PI protection.

Since 1 September 2000, solicitors have been required to arrange Solicitors Professional Indemnity Insurance cover with authorised insurers. Minimum indemnity limits are £2 million for any one claim, increasing to £3 million for LLPs. Oversight now sits with the Solicitors Regulation Authority, whose minimum policy terms must be met in full.

Most professional indemnity insurance is written on a claims-made basis, meaning the policy that responds is the one in force at the time the claim is made, not when the work itself was carried out.

This differs from claims-occurring policies, where the policy that was active at the time of the incident occurring responds, regardless of when the claim is made. Understanding this is essential, as it directly impacts how your cover operates and why continuous insurance is so important.

A retroactive date is a clause in a policy that allows the insurer to pay out claims made after the previous insurance policy has expired. This is done by endorsing the policy so that it covers incidents that occurred before the policy was issued/incepted. Retroactive dates are common in professional indemnity policies.

The new policy will then start at the “inception date”. Work done before the inception date of the new policy, all the way back to the retroactive date will then be covered. This would be subject to you not knowing of any previous incidents that could give rise to a claim under the new insurance policy. If there is a circumstance which could give rise to a claim, our advice would be to let the existing insurer know so they can log the potential claim as well as update the insurer who has quoted for your business. If the incident has been reported to your previous insurer then, they should acknowledge the claim should it then come in officially at a later date.
