What insurance do domiciliary care agencies need?
Employers' Liability insurance
Employers’ Liability insurance is required by law and covers the business against any legal action from employees in respect of an accident or injury suffered while at work. Should an employee launch a claim for compensation, for example, for a back injury incurred while moving a service user, this insurance policy can provide cover for defence costs as well as any potential compensation.
Public Liability insurance
Public Liability insurance covers you for action taken against the company by a third party. This could be a service user injuring themselves or having an accident while in your agency's care, for example. Public Liability insurance can cover your defence costs and any potential compensation if a claim is successfully instructed against the company. Typically, Public Liability will also extend to cover allegations of potential abuse made by a service user or their family.
Medical Malpractice insurance
Medical Malpractice occurs when a medical or health care professional, through a negligent act or omission, deviates from standards in their profession, thereby causing injury to a service user. This could be, for example, a failure to administer or prompt the use of medication.
Professional Indemnity insurance
This pays your legal costs, as well as any compensation payments that may be due, if your client takes legal action against you for a mistake you have made when providing professional services or advice that causes them a financial loss.

Directors & Officers insurance
D&O insurance covers company directors, managers and even employees, for claims made against them personally instead of the business. The claims made against individuals typically allege negligence, error or omission in the decisions made in the day-to-day running and operation of the business. Any allegations of wrongdoing naturally need to be investigated and defended, which can cost a significant amount, even if the case does not reach court. This means directors’ and officers’ personal finances are at risk, making it important for companies to provide protection through an insurance policy.
Legal Expenses insurance
There is a wide range of services covered under a Legal Expenses Insurance Policy; this can include cover in respect of property disputes, contract disputes and employment disputes. It is extremely important to understand the conditions applicable to a legal expenses policy, such as the prospect of success clause and advice precedent clause, which your broker should explain prior to cover being incepted.
Cyber insurance
As the world has evolved, general insurance policies have not adapted to include cyber threats. Cyber Insurance policies are instead available and can protect your business in respect of data breaches, ransomware, and cybercrime. There are also extensions available for Business Interruption and System Restoration in the event of cyberattacks that a typical domiciliary care insurance policy would not provide cover for. Given the amount of personal and sensitive data care organisations hold, cyber insurance is a key cover to consider and one we would highly recommend.
Loss Recovery insurance
This cover provides and pays for the cost of an independent loss adjuster to act on your behalf in the event of a claim. They will help you in the preparation of your claim, advise on remedial action and negotiate your claim with insurers. Having an expert working on your behalf at the time of a loss can be invaluable.
