About

Insurance for Residential Care Homes

At McClarrons, we operate a “not one shoe fits all” approach. We appreciate that care homes vary in the type of care and support they provide, the individuals they support, the technology used to deliver their services and their environment/property. We can assist single homes, as well as portfolios who support people who are elderly or those with complex needs, such as learning disabilities, mental health conditions, drug and alcohol rehabilitation, or specialist dementia care. We can also assist organisations providing care to children or hospice care.

We have access to a number of specialist care home insurance products for providers of residential care home services. This allows us to cater to your organisation’s needs and provide you with cover options. Naturally, all of our proposals will meet the requirements of the Care Quality Commission (or equivalent) and Local Authority contracts.

Insurance Requirements

What insurance do Care Homes need?

Employers’ Liability insurance

Employers’ Liability insurance is required by law and covers the business against legal action from employees in respect of an accident or injury suffered while at work. Should an employee launch a claim for compensation, for example, for a back injury incurred while moving a resident, this insurance policy can provide cover for defence costs as well as any potential compensation. Public Liability insurance

Public Liability insurance covers you for action taken against the company by a third party. This could be a resident injuring themselves or having an accident while in your care, for example. Public Liability insurance can cover your defence costs and any potential compensation if a claim is successfully instructed against the company. Typically, Public Liability will also extend to cover allegations of potential abuse made by a resident or their family. Contact Us

Medical Malpractice insurance

Medical Malpractice occurs when a medical or health care professional, through a negligent act or omission, deviates from standards in their profession, thereby causing injury to a patient. This could be, for example, a failure to administer or prompt the use of medication. Contact Us

Buildings & Contents insurance

Considerable amounts can be spent on assets so it is important you have the correct buildings and contents insurance in place to protect them. This can also extend to include amounts for residents' belongings. Contact Us

Business Interruption insurance

Triggered by a material damage claim such as a fire, this insurance can cover loss of revenue over a selected time frame. The purpose is to ensure the business remains financially stable during the time the property is unusable. Contact Us

Other insurances for Care Homes to consider

This pays your legal costs, as well as any compensation payments that may be due, if your client takes legal action against you for a mistake you have made when providing professional services or advice to them that causes them a financial loss.

D&O insurance covers company directors, managers and even employees, against claims made against them personally, instead of against the business. The claims made against individuals typically allege negligence, an error or omission in the decisions made in the day-to-day running and operation of the business. Any allegations of wrongdoing naturally need to be investigated and defended, which can cost a significant amount, even if the case does not reach court. This means directors’ and officers’ personal finances are at risk, making it important for companies to provide protection through an insurance policy.

As the world has evolved, general insurance policies have not adapted to include cyber threats. Cyber Insurance policies are instead available and can protect your business from data breaches, ransomware, and cybercrime. There are also extensions available for Business Interruption and System Restoration in the event of cyberattacks that a typical care home insurance policy would not provide cover for. Given the amount of personal and sensitive data care organisations hold, cyber insurance is a key cover to consider and one we would highly recommend.

There is a wide range of services covered under a Legal Expenses Insurance Policy; this can include coverage in respect of employment disputes, coroner’s inquests and compliance/regulatory action. It is extremely important to understand the conditions applicable to a legal expenses policy, such as the prospect of success clause and advice precedent clauses, which your broker should explain prior to cover being incepted.
