ABOUT COMPLEX CARE INSURANCE

Insurance for Complex Care Providers

Complex care providers support individuals with a wide range of physical, neurological, medical and behavioural needs, often requiring specialist training, enhanced supervision, bespoke care plans and specialist equipment. This can include supporting people with acquired brain injuries, neurological conditions, physical disabilities, learning disabilities and complex behavioural needs.

The nature of this work can create risks that differ significantly from those associated with more traditional domiciliary or residential care. Providers may need to consider additional exposures around treatment liability, safeguarding, specialist equipment, medication and the responsibilities of individual care professionals. It is therefore important that your complex care insurance reflects the services you actually provide and the level of care you deliver.

Our specialist team can help you understand these risks and arrange complex care business insurance tailored to your organisation, your workforce and the people you support. Whether you provide care in your client’s own homes, supported living environments or specialist settings, we can help you consider the protection your organisation needs.

WHO WE CAN HELP

Supporting Specialist Care Providers

We can help arrange complex care insurance for organisations delivering specialist care and support across a range of settings. This includes providers delivering 24-hour care, supporting people with neurological conditions, learning disabilities, dementia, those providing specialist behavioural support, and organisations involved in secure transport services.

If your organisation provides a combination of complex care and domiciliary care, we can also help ensure your insurance reflects the full range of activities you undertake, rather than treating each service in isolation.

Supporting Specialist Care Providers
THE COMPLEXITY OF SPECIALIST CARE

Understanding and Managing the Risks of Complex Care

Complex care providers can face a combination of clinical, physical, behavioural and operational risks, often requiring a higher level of training, supervision and specialist knowledge than more traditional care services. Employees may administer medication, provide clinical support, use specialist medical equipment or respond to complex behaviours, sometimes while working independently in environments the organisation does not control. Effective risk management starts with understanding how and where these risks arise. Clear care plans, individual risk assessments, appropriate staff training, equipment maintenance and robust reporting procedures can all help reduce the likelihood and impact of an incident. Key areas to consider include:

Medication management – appropriate procedures, training and recording

Manual handling – suitable assessments, equipment and staff competency

Safeguarding – clear processes for identifying and responding to concerns

Lone working – communication, welfare checks and emergency procedures

Specialist equipment – appropriate inspection, maintenance, training and contingency planning

Staff competency – ensuring employees have the skills and training required for the people they support

Emergency planning – preparing for incidents that could disrupt the delivery of care and have a significant impact on the business

Insurance should form part of this wider risk management approach. Understanding the risks associated with your services helps identify where complex care insurance and other specialist covers may be needed to protect your organisation.

Specialist Care Equipment
SPECIALIST EQUIPMENT

Insurance for Specialist Care Equipment

Complex care providers may rely on highly specialised equipment to deliver safe and effective care. This could include ceiling tracks and hoists, mechanical ventilators, BiPAP or CPAP machines, standing frames and bespoke sensory equipment. Some organisations may also operate modified or specialist vehicles, including vehicles used for secure transport or those equipped with blue-light capabilities.

The value, specialist nature and purpose of this equipment should be considered when arranging your insurance. We can help you understand how your complex care business insurance can respond to damage or loss involving essential equipment and whether additional considerations are required.

Supported Living

Supported Living Insurance

Supported living environments can present a different set of insurance considerations from traditional residential care. Providers may be responsible for delivering care and support within properties occupied by service users, while property ownership, tenancy and care responsibilities can sit with different organisations.

Your supported living insurance therefore needs to reflect the way your organisation operates, including the responsibilities of your staff, the services provided and any specialist equipment used. Our Care & Social Welfare team can help supported living providers consider their liability, property, professional and other insurance requirements alongside the specific risks associated with the people they support.

TREATMENT LIABILITY

When Standard Treatment Liability May Not Be Enough

Many care insurance policies include some level of treatment liability, typically covering standard carer duties and certain elements of nursing care. However, more complex or invasive forms of treatment and therapy may require a broader approach. For example, organisations employing or working with occupational therapists, prescribing nurses, physiotherapists or doctors may need to consider whether the treatment activities undertaken fall within the scope of their policy.

Where care involves more complex clinical interventions, a more comprehensive Medical Malpractice insurance solution may be appropriate. We can help you understand the distinction between treatment liability and medical malpractice and help ensure your insurance reflects the services your organisation actually provides.

How we do business - McClarrons
What makes us different

Why work with McClarrons?

Complex care requires an insurance approach that goes beyond a standard policy. Our specialist Care & Social Welfare team understands the different risks associated with delivering care in people’s homes, supported living environments and specialist settings.

We work with insurers that understand the care sector and can help arrange cover around your organisation’s individual activities. Whether you’re an established provider, expanding into complex care or setting up a new service, we will take the time to understand what you do before recommending appropriate protection.

COMPLEX CARE CLAIMS

Complex Care Insurance Claims

For complex care providers, an unexpected incident can have consequences that extend well beyond the immediate financial loss. An injury, medication error, safeguarding allegation or damage to specialist equipment could affect your staff, service users and ability to maintain continuity of care.

Complex care insurance can provide valuable financial protection when an insured event occurs but managing a claim itself can also be time-consuming and sensitive, particularly where allegations of negligence, service-user injuries, safeguarding concerns or specialist treatment are involved.

Our in-house Claims Team can support you throughout the process, liaising with insurers, loss adjusters and third parties on your behalf. With an understanding of the care sector and the importance and urgency of continuity of care, our role is to assist you in progressing claims efficiently, keeping you informed at every stage.

Questions & Answers

Complex Care Insurance FAQs

Complex care insurance is designed to help protect organisations providing higher levels of care or support to people with complex physical, medical, neurological or behavioural needs. The cover required will depend on the services provided, the professionals involved and the environments in which care is delivered.

The appropriate cover will vary between organisations but may include Employers’ Liability, Public Liability, Professional Indemnity, Treatment Liability, Medical Malpractice, Buildings & Contents, Cyber and Legal Expenses insurance. Specialist equipment and business interruption should also be considered.

This would depend on the activities covered by the policy and the insurer’s terms and conditions. If a domiciliary care provider delivers complex or specialist services, it is important to discuss these activities with your broker to ensure the policy provides appropriate protection.

Whether Medical Malpractice insurance is appropriate will depend on the clinical and treatment activities your organisation undertakes. Providers delivering more complex or invasive treatment may need broader clinical liability protection than that provided under standard Treatment Liability.

Supported living insurance is designed to address the insurance requirements of organisations providing care or support within supported living environments. Depending on the arrangement, this may include liability, professional risks, property and specialist equipment.

Supported living providers delivering complex care should ensure their insurance reflects both the nature of the accommodation and the care services provided. The responsibilities of the care provider, property owner and other parties should be considered when arranging cover.
