What a difference a legal expert makes

Not all insurance claims are as straightforward as a financial fix in the form of a settlement. For many businesses, they also need to help side-step legal repercussions. With a Rural Protect policy arranged by McClarrons, policyholders also get the benefit of legal expertise from law specialists rradar. This case study shows just how valuable this expertise can be.

The case study below is the perfect example of how a simple task can quickly turn into a precarious situation with serious legal implications. It’s because this can happen only too often that a Rural Protect policy arranged by McClarrons comes with unlimited support from legal specialists rradar. If policyholders find themselves in a similar position to the business in the case study – they know that expert guidance is only a phone call away:

Accident investigation – case study

Several of the farm workers in an agricultural company were told to clear a blocked drain at ground level in one of the farm’s cattle sheds. Without instruction from or knowledge of the company, the workers climbed up onto the roof of the shed to clean out a gutter.

One worker fell through a skylight, suffering a serious back injury as a result. The Health and Safety Executive (HSE) began a criminal investigation, alleging that the client, the agricultural company, had failed to ensure the work at height undertaken was planned, supervised and carried out in a safe manner. The HSE invited the client to attend an interview under caution, indicating that a criminal prosecution was contemplated.

Using the wealth of resources in their Advice Resource Centre, rradar prepared and advised the client in advance and represented them at the interview, advising and assisting the attending director through the process and making representations on the company’s behalf to the HSE.

rradar’s advice, support and representation were crucial in enabling the client to mount a robust defence, which resulted in the HSE deciding not to prosecute the company, thereby avoiding heavy fines or possible imprisonment.

Unlimited legal support is just one of the benefits of a Rural Protect policy, which has been designed to help agricultural businesses with difficult legal situations and liability claims. To find out more contact McClarrons on 01653 697055 or email enquiries@mcclarroninsurance.com.
